Terms & Conditions of Engagement

These terms govern all plumbing, gas, drainage and contracting work supplied by North Contracting Group Pty Ltd. Last updated 9 March 2026.

These Terms and Conditions of Engagement (Terms) govern all plumbing, gas fitting, drainage, hot water, leak detection, backflow prevention, water filtration, renovation, maintenance, commercial maintenance, and related contracting services supplied by North Contracting Group Pty Ltd trading as North Contracting Group (NCG, we, us, our) to the client engaging us (Client, you, your).

NCG services Perth's northern suburbs, Lancelin, Nilgen, Jurien Bay and surrounding areas, the Pilbara, and other regional and remote locations across Western Australia, subject to availability.

By booking a site visit, requesting a quote, accepting a quote, paying a deposit, ordering goods, or authorising us to proceed with any work, you agree to be bound by these Terms.

1. Definitions

Unless the context otherwise requires, the following terms have the meanings given below:

Additional Work

Any work outside the original agreed scope, including variations, latent conditions, access issues, safety-related work, compliance rectification, or extra work requested by the Client.

Authority to Proceed

Your verbal, written, emailed, texted, or other recorded approval for NCG to begin or continue Work.

Contract

The agreement between NCG and the Client formed by these Terms together with any Quote, invoice, scope, variation, work order, or other written communication forming part of the agreed supply.

Deposit

Any upfront payment required by NCG before ordering goods, reserving labour, scheduling work, or commencing Work.

Goods

All products, fixtures, fittings, appliances, materials, and equipment supplied by NCG.

Quote

A written quote, estimate, pricing proposal, or scope issued by NCG.

Services

All plumbing, gas, drainage, hot water, leak detection, testing, maintenance, installation, repair, replacement, renovation, commercial maintenance, or related contracting services supplied by NCG.

Site

The property or location where Goods are delivered or installed and/or Services are performed.

Site Visit

An attendance by NCG to inspect, assess, diagnose, scope, quote, test, or otherwise review requested Work.

Site Visit Fee

The call-out, attendance, assessment, or inspection fee advised by NCG before or at the time of booking.

Work

Any Goods and/or Services supplied by NCG, including Additional Work.

Work Frustration

Any event or circumstance beyond NCG's reasonable control that prevents, delays, or materially changes the completion of Work, including weather, unsafe conditions, hidden defects, restricted access, authority delays, supplier delays, or third-party interference.

2. Site Visit Bookings

2.1 Booking Conditions

When you book a Site Visit, you agree to:

pay the advised Site Visit Fee;

provide safe and reasonable access to the Site;

ensure an authorised adult is available during the attendance window where required; and

comply with the cancellation terms in clause 3.

2.2 Purpose of a Site Visit

A Site Visit may include inspection, diagnosis, testing, scoping, estimating, quoting, or determining whether fixed pricing is possible. Some plumbing and gas issues cannot be accurately priced until further investigation is completed on-site.

2.3 Site Visit Fee

If you do not proceed with the Work, the Site Visit Fee is payable upon completion of the Site Visit unless otherwise agreed in writing.

If you do proceed and NCG agrees in writing, the Site Visit Fee may be credited toward the Work or included in the Quote.

3. Cancellations and Access

3.1 Cancellation Notice

You must give at least 12 hours' written notice to cancel or reschedule a Site Visit.

3.2 Late Cancellation, No Attendance, or No Access

The Site Visit Fee remains payable if:

you cancel with less than 12 hours' notice;

an authorised person is not present during the agreed attendance window where required; or

NCG cannot reasonably access the Site.

3.3 Cancellation After Acceptance

If you cancel Work after accepting a Quote, or after NCG has ordered materials, reserved labour, or otherwise incurred costs, NCG may retain or charge reasonable amounts already incurred or committed in connection with the Work, to the extent permitted by law.

4. Contract Formation

A Contract for Work is formed when:

you accept our Quote or provide Authority to Proceed;

you pay a Deposit or advance payment for the Work;

you instruct NCG to commence the Work; or

NCG commences the Work following your approval.

You are responsible for providing accurate site, access, and service information. NCG is not liable for delays, additional costs, or defects arising from inaccurate, incomplete, or misleading information supplied by you or on your behalf.

5. Quotes, Estimates, and Variations

5.1 Quote Validity

Unless otherwise stated, Quotes are valid for 30 days from the date issued.

5.2 Estimates

Any estimate is indicative only and may change if site conditions, materials, access requirements, safety requirements, compliance issues, hidden defects, or scope assumptions differ from what was reasonably apparent when pricing was prepared.

5.3 Hidden or Pre-Existing Conditions

Quotes are based on visible and reasonably available information only. Hidden, undocumented, or pre-existing defects or non-compliances are outside the quoted scope unless expressly included.

5.4 Variations and Additional Work

If Additional Work is required, NCG may issue a revised Quote or variation. NCG is not required to proceed with Additional Work until you approve the revised scope and price.

6. Deposits, Invoices, and Payments

6.1 Deposits and Advance Payments

NCG may require payment in advance, including:

a Deposit;

progress payments;

full payment for special-order Goods; or

full payment before supply or installation of certain Goods, including hot water systems.

6.2 Effect of Deposit

NCG is not obliged to schedule Work, order Goods, reserve stock, or commence Services until the required Deposit is received in cleared funds.

6.3 Non-Refundable Components

To the extent permitted by law, and subject to any rights you may have under the Australian Consumer Law, Deposits may be non-refundable where they relate to:

custom, special-order, or non-returnable Goods;

supplier commitments already made;

labour or time specifically reserved for your Work; or

cancellation after Quote acceptance.

6.4 Invoices

NCG may issue invoices for:

Site Visit Fees;

Goods supplied;

Services performed;

progress claims; and

Additional Work.

6.5 Payment Terms

Unless otherwise agreed in writing, payment is due on the date stated in the invoice. If no due date is stated, payment is due on the day of issue.

6.6 Payment Methods

Payments may be made by any method approved by NCG, including EFT, EFTPOS, debit card, credit card, or cash where accepted.

6.7 Card Surcharges

NCG may apply a disclosed surcharge for card payments. Any applicable surcharge will be communicated before or at the time of payment.

6.8 Late Payment

Late payments may result in:

suspension of Work;

reasonable debt recovery or administration costs; and

interest on overdue amounts at 10% per annum, calculated daily, to the extent permitted by law.

7. Client Responsibilities and Site Access

You must:

provide safe, clear, and uninterrupted access to the Site;

ensure an authorised person aged 18 or over is available to make decisions, approve variations, and arrange payment where required;

disclose all relevant information about the Site, including known defects, hazards, prior works, concealed services, and approvals;

clearly identify, or arrange identification of, underground, in-wall, in-floor, or concealed services where relevant;

provide reasonable access to water, power, parking, and amenities where required; and

ensure children, pets, occupants, and third parties are kept clear of the work area.

If access is delayed, prevented, or interrupted, you must reimburse NCG for reasonable resulting costs, including reattendance, labour downtime, equipment hire, or rescheduling costs.

8. Scope of Services

NCG provides a wide range of plumbing and gas contracting services across Perth's northern suburbs, Lancelin, Jurien Bay, the Pilbara, and regional Western Australia, including:

General plumbing maintenance and repairs

Gas fitting and gas appliance connection

Blocked drains and drainage services

Leak detection and repairs

Hot water system supply, replacement, and installation

Backflow prevention and testing

Water filtration and related water services

Renovations, fit-outs, and rough-ins

Commercial plumbing maintenance

Related contracting services

Urgent or reactive maintenance work may require staged attendance, investigation, or revised pricing before a fixed price can be confirmed.

9. Hot Water Systems

9.1 Standard Pricing Assumptions

Any advertised or quoted installation price for a hot water system in Perth's northern suburbs or regional WA is generally based on:

a like-for-like replacement of a same or similar unit;

no material change to location, type, or energy source;

existing plumbing, gas, drainage, and electrical infrastructure being suitable and compliant; and

reasonable access to remove and install the system.

9.2 Additional Work

If additional valves, pipework, tempering valves, drip trays, drains, electrical works, pressure regulation, gas upgrades, relocation works, structural works, or compliance rectification are required, NCG may issue a revised Quote before proceeding.

9.3 Payment Before Installation

NCG may require full payment before ordering, delivering, or installing a hot water system.

9.4 Existing Site Defects

NCG is not liable for pre-existing faults, defects, or non-compliances in the Site's plumbing, gas, electrical, drainage, or related systems discovered before, during, or after hot water replacement, except to the extent caused by NCG's breach of law or failure to exercise due care and skill.

10. Gas Work and Safety Compliance

All gas fitting work carried out by NCG is performed in accordance with applicable Western Australian laws, regulations, licence requirements, and relevant technical standards.

Where required, NCG may carry out tightness, pressure, commissioning, or compliance tests. If unsafe or non-compliant gas work is identified, NCG may be required to isolate or disconnect the affected service and/or report the matter to the relevant authority or network operator where required by law.

Any rectification work required to make the installation safe or compliant may be treated as Additional Work unless already included in the Contract.

11. Warranties and Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

NCG warrants that its Services will be provided with due care and skill and in a proper and workmanlike manner consistent with normal trade standards.

Subject to your non-excludable rights:

manufacturer warranties apply to Goods supplied by NCG where relevant;

no warranty is given that blocked drains, sewer blockages, stormwater blockages, or drainage issues will not recur;

warranty does not cover misuse, neglect, accidental damage, vandalism, unauthorised repairs, poor maintenance, abnormal conditions, fair wear and tear, or pre-existing site defects; and

consumables or minor components affected by misuse or overtightening are not covered.

If you believe there is a defect in any Goods or Services, notify NCG in writing as soon as reasonably practicable after becoming aware of it, and where possible within 7 days, so that NCG can inspect and, if appropriate, rectify the issue.

If NCG accepts that Goods or Services are defective, NCG may, subject to your rights under the Australian Consumer Law, repair, replace, or re-supply the relevant Services, provide a refund or partial refund, or provide a reasonable credit.

12. Liability

To the maximum extent permitted by law, NCG is not liable for:

hidden defects, latent conditions, or pre-existing site issues;

damage caused by inaccurate, incomplete, or misleading information supplied by you;

damage to concealed services, cables, pipes, or infrastructure not properly identified to NCG;

unavoidable minor damage reasonably incidental to carrying out Work where access is restricted or conditions are poor;

delays caused by weather, supply shortages, authority delays, emergency call-outs, or third parties; or

indirect, consequential, or economic loss, including loss of rent, loss of profit, loss of opportunity, or business interruption.

When working on roofs, in ceiling spaces, under floors, or through internal areas due to limited access, NCG will take reasonable care. Subject to law, NCG is not responsible for unavoidable breakage or incidental damage involving fragile, aged, deteriorated, or inaccessible materials.

To the maximum extent permitted by law, NCG's total liability arising from any one event or series of related events is limited to the lesser of:

the cost of re-supplying the affected Services;

the cost of replacing or repairing the affected Goods; or

the amount actually paid by you for the affected part of the Work.

This clause does not apply to the extent liability cannot lawfully be excluded or limited.

13. Indemnity

You indemnify NCG against loss, damage, cost, or expense arising from:

your breach of these Terms;

unsafe site conditions caused by you or persons under your control;

your failure to provide required consents, approvals, or accurate information; or

claims by third parties arising from your instructions, your property condition, or your acts or omissions.

This indemnity is reduced to the extent the loss was caused or contributed to by NCG's negligence, breach of contract, or breach of law.

14. Force Majeure, Delays, and Work Frustration

NCG is not liable for delay or failure to perform Work due to causes beyond its reasonable control, including weather, flood, fire, industrial action, supplier shortages, authority delays, illness, equipment failure, emergency call-outs, hidden defects, access issues, safety risks, or third-party acts.

If Work Frustration occurs, NCG may:

suspend or reschedule the Work;

invoice for Work already performed, materials ordered, and reasonable costs incurred or committed; and

apply any advance payment to those amounts, with any remaining balance dealt with in accordance with the Contract and applicable law.

15. Equipment Damage and Retrieval

If drain jetting hoses, CCTV drain cameras, or other equipment becomes stuck, lost, or damaged due to pipe condition, collapse, obstruction, foreign objects, root intrusion, or other site conditions beyond NCG's reasonable control, NCG may charge you the reasonable cost of retrieval, repair, replacement, excavation, or reinstatement associated with that event.

NCG is not liable for damage necessarily caused in the course of retrieving equipment where such retrieval was reasonably required.

16. Ownership of Goods and PPSA

Title to Goods supplied by NCG does not pass to you until NCG has received full payment for those Goods and any associated amounts owing under the Contract.

Risk in the Goods passes to you upon delivery to the Site.

You grant NCG a security interest in the Goods and their proceeds under the Personal Property Securities Act 2009 (Cth) to secure payment of all amounts owing. You agree to do all things reasonably required by NCG to register, perfect, or enforce that security interest, including providing information and signing documents if requested.

17. Suspension and Termination

NCG may suspend Work immediately if:

payment is overdue;

the Site is unsafe;

access is denied or materially delayed;

you fail to approve necessary variations; or

continuing the Work would expose NCG to unreasonable safety, compliance, legal, or financial risk.

If either party materially breaches the Contract, the other party may give 7 days' written notice requiring that breach to be remedied. If the breach is not remedied within that period, the non-defaulting party may terminate the Contract.

NCG may also terminate the Contract immediately where continuing the Work would be unlawful or unsafe.

If the Contract is terminated, NCG may recover all amounts due together with reasonable costs incurred up to the date of termination. If NCG terminates the Contract before supplying the relevant Goods or Services, NCG will refund any unused advance payment after deducting amounts reasonably incurred or committed by NCG in connection with the Work, to the extent permitted by law.

18. Intellectual Property

All intellectual property rights in any design, drawing, plan, proposal, quote format, image, video, template, or document created by NCG remain the property of NCG unless otherwise agreed in writing.

You may use those materials only for the purpose for which they were supplied and not for reproduction, resale, tendering to others, or use on another project without NCG's written consent.

19. Privacy, Recordings, and Marketing

NCG may collect, use, and disclose your personal information for the purposes of:

quoting, booking, and supplying Goods and Services;

administration and payment processing;

customer service and quality assurance;

debt recovery;

engaging contractors, suppliers, or service providers reasonably required to complete the Work; and

marketing additional services.

To the extent permitted by law, NCG may record calls and take photographs or video of the Work and Site conditions for record-keeping, training, quality assurance, warranty assessment, compliance, and marketing purposes.

If you do not want photographs or video used for marketing purposes, you must notify NCG in writing before attendance.

NCG will take reasonable steps not to publish your personal information without consent, unless required or permitted by law. You may opt out of marketing communications at any time.

20. Notices

A notice under these Terms must be in writing and may be given by hand, email, post, or SMS.

A notice to you may be sent to the Site address, your last known residential or business address, your email address, or your mobile number last provided to NCG.

A notice sent by email or SMS is taken to be received on the day sent if sent before 5:00 pm on a business day, otherwise on the next business day, unless an undeliverable or failed message is received.

21. General

NCG may update these Terms from time to time by publishing the updated version on its website. Updated Terms apply only to future bookings, quotes, and Contracts entered into after publication, unless otherwise agreed in writing.

If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part is severed and the remainder continues in full force and effect.

These Terms, together with any Quote, invoice, and approved variation, form the entire agreement between the parties about the relevant Work. If there is any inconsistency between these Terms and an accepted Quote or approved variation, the accepted Quote or approved variation prevails to the extent of the inconsistency.

Where applicable, residential building or renovation work may also be subject to mandatory requirements under Western Australian building services legislation, including the Home Building Contracts Act 1991 (WA), and those requirements continue to apply in addition to these Terms.

These Terms are governed by the laws of Western Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Western Australia.
